§ 1. General provisions

  1. These Terms and Conditions set out the rules for using the website available at wipcool.pl, including the types and scope of services provided electronically, the conditions for providing them, for concluding and terminating agreements, and the complaints procedure. We issue them under Article 8 of the Act of 18 July 2002 on the provision of electronically supplied services.
  2. The Website is operated and the services are provided by 4REF spółka z ograniczoną odpowiedzialnością, with its registered office in Białystok, ul. Gen. Władysława Andersa 38, 15-113 Białystok, entered in the Register of Entrepreneurs of the National Court Register by the District Court in Białystok, 12th Commercial Division of the National Court Register, under KRS number 0000645680, NIP (tax ID) 5423262230, REGON 365817646, share capital PLN 100,000.00 (hereinafter: the ‘Service Provider’, ‘we’). The Service Provider is the distributor of the Wipcool brand in Poland and Europe.
  3. Contacting the Service Provider: email bok [at] wipcool.pl, telephone +48 85 888 00 85, correspondence address: ul. Gen. Władysława Andersa 38, 15-113 Białystok.
  4. These Terms and Conditions are available free of charge on this page before you start using the services. You can print or save them, e.g. using your browser's ‘Print’ or ‘Save as PDF’ function.
  5. The Website is available in several languages. The Polish version of these Terms and Conditions is binding.

§ 2. Definitions

  • Website - the wipcool.pl website together with its language versions.
  • User - any person using the Website.
  • Consumer - a natural person who uses the Website or concludes an agreement with us for a purpose not directly related to their business or professional activity.
  • Sole trader with consumer rights - a natural person running a sole proprietorship who concludes an agreement directly related to that business, where the content of the agreement shows that it is not of a professional nature for that person, resulting in particular from the subject of their business as disclosed in the CEIDG.
  • Services - the services provided electronically on the Website, described in § 4.
  • Service request - a request for warranty or out-of-warranty repair of a Wipcool device, submitted using the form on the Warranty and service page.
  • Request page - a page under an individual link showing the status of the Service request.
  • Distributor - an authorised seller of Wipcool products, including an online shop, to which links from the Website lead.

§ 3. Nature of the Website

  1. The Website is a catalogue of Wipcool products with technical information, documents, advice and a list of Distributors. Products cannot be purchased on the Website and no sales agreements are concluded on it.
  2. Prices shown on the Website are list prices and are for information only. They do not constitute an offer within the meaning of Article 66 of the Civil Code. The final price and terms of sale are set by the Distributor from whom you buy.
  3. The ‘Buy online’ and ‘Where to buy’ buttons lead to Distributors' websites. You conclude the sales agreement with the Distributor, on its terms and in accordance with its terms and conditions. Information on availability in shops is taken from their data periodically and may differ from actual stock in the shop.
  4. We make every effort to keep product information up to date and correct. The binding technical specifications are in the documentation supplied with the product. Product selector results are an aid to selection; the final decision on selection and installation is made by the User or the installer, taking the installation conditions into account.

§ 4. Services

We provide the following Services on the Website free of charge:

  1. browsing the product catalogue, advice and information pages,
  2. search for products, documents and advice,
  3. product selection based on installation parameters entered by the User,
  4. a list and map of Distributors and selection of the country for which we show prices, shops and Distributors,
  5. downloading documents: user manuals, datasheets, declarations of conformity, catalogues and price lists,
  6. a contact form that allows you to send us a message,
  7. a newsletter, i.e. sending information on new products, promotions and updates to Wipcool products to the email address provided,
  8. the Service request form, the Request page and, for shipments from Poland, a downloadable InPost label,
  9. submitting, from the Request page, your decision on the cost of an out-of-warranty repair.

The Services are free of charge. Only the out-of-warranty repair itself is chargeable, under the rules set out in § 9. You bear the cost of your internet connection according to your operator's tariff.

§ 5. Technical requirements

  1. To use the Website, you need a device with internet access and an up-to-date web browser (e.g. Chrome, Firefox, Safari, Edge) with JavaScript enabled. Without JavaScript you can browse the content, but the search, product selector and forms do not work.
  2. To use the newsletter and the Service request, you need an active email account, and for the Service request also a telephone.
  3. To open documents and the InPost label, you need a program for PDF files, and for the label also a printer.
  4. The forms are protected by Cloudflare Turnstile, which automatically checks whether they are being sent by a human. Your browser must not block the challenges.cloudflare.com script.
  5. The Website stores essential information in your browser, e.g. the selected country. The rules are described in the Cookie policy.

§ 6. Conclusion and termination of the agreement for the provision of Services

  1. You conclude the agreement for browsing the Website, the search, the product selector, the list of Distributors and downloading documents when you open the Website. It terminates when you leave the Website.
  2. You conclude the agreement for sending a message via the contact form when you submit the form. We perform it by replying to the message.
  3. You conclude the newsletter agreement when you provide your email address and confirm your subscription using the link in the message we then send. The agreement is concluded for an indefinite period. You can terminate it at any time, without giving a reason and at no cost, by clicking the unsubscribe link in any message or by writing to bok [at] wipcool.pl.
  4. You conclude the agreement for handling an online Service request when you submit the form. The Request page is available for as long as the order is in our service system.
  5. We may terminate the newsletter agreement with 14 days' notice if we stop sending the newsletter, and without notice if the User seriously breaches these Terms and Conditions or the law, e.g. by sending spam or malware.

§ 7. Rules for using the Website

  1. Use the Website in accordance with the law, good practice and these Terms and Conditions.
  2. Providing unlawful content is prohibited, including offensive content or content that infringes personal rights or the rights of others, as well as spam and malware.
  3. Circumventing the Website's security measures, automated form submission, placing an excessive load on the Website and automated downloading of its content for the purpose of mass copying are prohibited.
  4. Provide true data in the forms. You may provide another person's data only if you are entitled to do so, e.g. as a contact person on behalf of a company.
  5. The number of form submissions from a single IP address within a short time is limited. We may leave messages sent in breach of these Terms and Conditions unanswered.

§ 8. Online service request

  1. You use the form to submit Wipcool devices for warranty or out-of-warranty repair. The warranty terms (period, scope, exclusions, processing time, shipping costs) are described on the Warranty and service page and in the product's warranty document.
  2. The manufacturer warranty does not exclude, limit or suspend the buyer's rights against the seller under the provisions on statutory liability for defects or, in the case of a Consumer and a Sole trader with consumer rights, under the provisions on liability for lack of conformity of goods with the contract.
  3. Once you submit the form, your request is sent to the Service Provider's service system. You receive a link to the Request Page on screen and by e-mail, and the service order number and further repair updates are sent by e-mail from the service system.
  4. For requests with an address in Poland: for most devices, the Request Page provides an InPost label for you to print and drop off at an InPost point or Paczkomat parcel locker; bulky devices are collected by a courier, and we will contact you to arrange collection. If no label is available, we will send you the consignment note by e-mail. Do not send the device before you receive the label or the courier details.
  5. For requests submitted from a website in a language other than Polish, you send the device yourself to the service address given in the e-mail, and only after you receive the service order number.
  6. Include a copy of the proof of purchase and a note stating the model and serial number with the shipment. Send the device only, without accessories or loose small parts (e.g. batteries, chargers, adapters, hoses, nozzles, connectors, O-rings, screws) - they are not needed for the repair. We will return everything we receive together with the device, but we are not liable for the loss of or damage to any enclosed accessories and small parts, including in transit. This exclusion does not apply to Consumers or Entrepreneurs with consumer rights - towards them we are liable under general rules.
  7. Pack the device so that it is not damaged in transit. If possible, drain any liquids from the device, e.g. water from the pressure washer tank.
  8. The link to the Request Page works as an access key: anyone who has it can see the repair status and submit a decision on the cost. Do not share it with third parties.

§ 9. Out-of-warranty repair

  1. Out-of-warranty repairs, as well as repairs under a request that is not accepted as a warranty claim, are chargeable. After diagnosing the device, we prepare a quote and display it on the Request Page or send it by e-mail. The quote states the scope of the repair, the gross repair price including VAT, the cost of returning the device and the estimated repair completion date.
  2. We carry out the repair only after you accept the quote. Before accepting, you have access to these Terms and Conditions. You accept the quote with the ‘I accept the repair cost’ button on the Request Page or by e-mail. Upon acceptance, we conclude a repair contract and you undertake to pay the stated price. If the quote changes, we will ask you to accept it again.
  3. If you do not accept the quote and choose to withdraw, we will return the device unrepaired.
  4. The cost of returning the device after an out-of-warranty repair or after withdrawal from the repair is borne by the customer, at the rate stated in the quote. Shipping costs for requests not accepted as warranty claims are set out in the warranty terms on the Warranty and service page.
  5. Payment is made by bank transfer on the basis of an invoice or document sent before the device is returned, unless agreed otherwise. We provide a warranty on the repair carried out on the terms stated in the quote or in the repair document.
  6. We are liable for defects in the repair carried out in accordance with the provisions of the Civil Code on statutory liability for defects in work performed (rękojmia). The warranty on the repair does not exclude or limit this liability.
  7. We confirm the repair contract by e-mail (on a durable medium) together with the content of the quote. We do not apply a code of good practice within the meaning of the Act on Counteracting Unfair Market Practices.
  8. Right of withdrawal (Consumers and Entrepreneurs with consumer rights). A repair contract concluded via the Request Page or by e-mail is a distance contract. A Consumer and an Entrepreneur with consumer rights may withdraw from it without giving any reason within 14 days of its conclusion by submitting a statement to us, e.g. by e-mail to bok [at] wipcool.pl. To meet the deadline, it is sufficient to send the statement before it expires. You may use the model withdrawal form set out in Annex 2 to the Act of 30 May 2014 on Consumer Rights, but this is not obligatory.
  9. We start the repair before the withdrawal period expires only at your express request, which you make when accepting the quote. Without such a request, we will start the repair after 14 days from the conclusion of the contract. If you request that the repair start earlier and then withdraw from the contract, you will pay for the part of the repair performed up to the time of withdrawal, in proportion to the price in the quote.
  10. The right of withdrawal does not apply if we have fully performed the repair with your express prior consent and, before the repair started, you were informed that you would lose the right of withdrawal once the repair has been performed, and you acknowledged this.
  11. Withdrawal from the repair contract does not affect your rights under the warranty.

Model statement of withdrawal from the contract:

§ 10. Newsletter

  1. The newsletter contains commercial information about Wipcool products, promotions, new products and tips. We send it only to people who have subscribed and confirmed their subscription.
  2. Subscribing means consenting to receive commercial information electronically at the e-mail address provided. You may withdraw your consent at any time, which means unsubscribing from the newsletter.
  3. How often we send it depends on new additions to our range. We do not pass e-mail addresses on to other companies for marketing purposes.

§ 11. Complaints about the Services

  1. You may submit complaints about the operation of the Website and the Services by e-mail to bok [at] wipcool.pl or in writing to the Service Provider's registered office address.
  2. In your complaint, provide your contact details, a description of the problem and, if possible, the date, time and address of the page on which the problem occurred. This will help us resolve it faster.
  3. We will process your complaint within 14 days of receiving it and reply to the e-mail address or postal address from which it was sent.
  4. Complaints about products are submitted in accordance with the warranty terms (§ 8) or to the Distributor from whom you purchased the product.
  5. A Consumer may use out-of-court complaint handling and redress procedures, e.g. the assistance of a municipal or district consumer ombudsman, consumer organisations or the Voivodeship Inspectorate of Trade Inspection. Information is available on the website of the Office of Competition and Consumer Protection uokik.gov.pl. Participation in such proceedings is voluntary for both parties. If we do not uphold a Consumer's complaint, we will state in our reply whether we agree to an out-of-court settlement of the dispute.

§ 12. Liability

  1. We strive to ensure the continuous and correct operation of the Website. Interruptions may occur, e.g. due to technical work, failures or actions of service providers. We will do our best to keep them as short as possible.
  2. The owners of Distributors' websites, shops and other websites to which links lead are responsible for their content and operation.
  3. Towards Users who are neither Consumers nor Entrepreneurs with consumer rights, we are liable for damage related to free Services only if we caused it intentionally or through gross negligence.
  4. These Terms and Conditions do not exclude or limit the rights of Consumers and Entrepreneurs with consumer rights arising from mandatory provisions of law.

§ 13. Risks associated with using the internet

Pursuant to Article 6 of the Act on the Provision of Electronic Services, we inform you that using the internet involves risks, e.g. malware, data theft (phishing) and impersonation of well-known companies. Use an up-to-date browser and antivirus software, and check the website address and the sender of messages. We send messages about service requests from the wipcool.pl domain and from the 4REF service system. We never ask for passwords or payment card details by e-mail.

§ 14. Copyright

  1. The content of the Website, including texts, photographs, graphics, documents and page layout, is protected by copyright and trade mark law. Wipcool is a trade mark of its owner.
  2. You may view and download content and documents for your own use, including in connection with the selection, installation and servicing of Wipcool products. Any other use, in particular copying content to other websites for commercial purposes, requires our consent, unless the law permits such use without consent.
  3. Distributors may use Wipcool product descriptions and photographs on terms agreed with the Service Provider.

§ 15. Personal data

The controller of Users' personal data is the Service Provider. The rules for processing data and Users' rights are described in the Privacy Policy, and cookies in the Cookie Policy.

§ 16. Changes to the Terms and Conditions

  1. We may change the Terms and Conditions for valid reasons: changes in the law, changes to the scope or manner of providing the Services, technical changes or the need to improve the security of the Website.
  2. We publish the new version on the Website together with the date from which it applies. We notify newsletter subscribers of the change by e-mail at least 14 days before it takes effect. If you do not accept the changes, you may unsubscribe from the newsletter during this period.
  3. Service requests and repair agreements concluded before the change are governed by the Terms and Conditions in the version in force on the date they were concluded.

§ 17. Final provisions

  1. The Terms and Conditions and agreements concluded on their basis are governed by Polish law. The choice of Polish law does not deprive a Consumer of the protection afforded by the mandatory provisions of the law of the country in which the Consumer has their habitual residence.
  2. Disputes with Users who are neither Consumers nor Entrepreneurs with consumer rights are resolved by the court having jurisdiction over the Service Provider's registered office. Disputes with Consumers are resolved by the court having jurisdiction under the general provisions of law.
  3. These Terms and Conditions apply from 1 November 2026.
